Habit Hound Terms of Service

1. Acceptance of terms

These Terms of Service (“Terms”) are a binding agreement between you and Goodwater Labs (“we,” “us,” “our”) and govern your use of the Habit Hound iOS application and any related services we make available (collectively, the “Service”). By downloading, installing, or using Habit Hound, you agree to these Terms. If you do not agree, do not use the Service.

If you are using Habit Hound on behalf of someone else (for example, a minor in your family), you represent that you have authority to accept these Terms on their behalf.

2. Description of service

Habit Hound is a habit-tracking application for iOS. It lets you define habits and tasks, mark them complete, and use Apple’s Screen Time / Family Controls frameworks to restrict access to apps you have chosen to block until those tasks are done. Habit Hound is a tool — not a guarantee of any particular behavioral outcome.

3. Apple App Store

You acquired Habit Hound through the Apple App Store. Your use is also subject to Apple’s Media Services Terms and Conditions (https://www.apple.com/legal/internet-services/itunes/). In the event of a conflict between Apple’s terms and these Terms with respect to the App Store distribution of Habit Hound, Apple’s terms control to the extent of the conflict.

You acknowledge that these Terms are between you and Goodwater Labs, not Apple, and that Apple is not responsible for Habit Hound or its content. Apple has no obligation to provide maintenance or support for Habit Hound. To the maximum extent permitted by law, Apple has no warranty obligation for Habit Hound. Apple is a third-party beneficiary of these Terms and may enforce them against you.

4. Subscriptions and in-app purchases

Habit Hound offers auto-renewing subscriptions, collectively called Habit Hound Premium. All purchases are processed by Apple through your Apple ID.

Subscription details

  • Habit Hound Premium — Monthly. Auto-renewing subscription billed at US$4.99 per month, or the equivalent in your local currency as set by the App Store.
  • Habit Hound Premium — Annual. Auto-renewing subscription billed at US$24.99 per year, or the equivalent in your local currency as set by the App Store.

Auto-renewal

Subscriptions automatically renew at the end of each billing period for the same duration and at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.

Managing and cancelling

You can manage and cancel subscriptions at any time in Settings → [your name] → Subscriptions on your iOS device, or at https://apps.apple.com/account/subscriptions. Cancelling takes effect at the end of the current paid period; you continue to have access until then. Uninstalling Habit Hound does not cancel a subscription.

Payment

Payment is charged to your Apple ID at confirmation of purchase. Prices displayed in the App Store are inclusive of applicable taxes where required.

Free trials

Each subscription includes a 7-day free trial for new subscribers. The subscription begins and your Apple ID is charged at the end of the trial period unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription. Free trials are limited to one per user as determined by Apple.

Refunds

All payments are processed by Apple, and refunds are handled by Apple under their policies, not by Goodwater Labs. To request a refund, visit https://reportaproblem.apple.com and sign in with the Apple ID used for the purchase. We do not have the ability to issue refunds directly.

5. Acceptable use

You agree not to:

  • Use Habit Hound for any unlawful purpose or in violation of any applicable law or regulation.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of Habit Hound, except to the extent applicable law prohibits this restriction.
  • Use Habit Hound to circumvent parental controls, employer device management, or other access controls that you are not authorized to bypass.
  • Attempt to interfere with the integrity or performance of the Service or the systems of any third party.

6. Intellectual property

The Habit Hound application, the Goodwater Labs name and logo, and all related software, designs, text, and graphics are owned by Goodwater Labs or our licensors and are protected by copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use Habit Hound on Apple-branded devices you own or control, in accordance with the App Store Terms and these Terms.

You retain all rights to the habits, tasks, notes, and other content you create in Habit Hound (“Your Content”). Because Your Content stays on your device, we do not need and do not receive a license to it.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

App blocking is a behavioral tool, not a security boundary. It depends on Apple’s Screen Time / Family Controls frameworks and on you keeping Screen Time authorization granted; a determined user can disable Screen Time, delete Habit Hound, or otherwise bypass the restriction. Habit Hound is not a substitute for parental controls or for professional treatment of attention, compulsion, or addiction-related conditions.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOODWATER LABS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US (THROUGH APPLE) FOR HABIT HOUND IN THE TWELVE MONTHS PRECEDING THE CLAIM AND (B) US$50.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply to the maximum extent permitted by law.

9. Termination

You may stop using Habit Hound at any time by uninstalling the app and, if applicable, cancelling your subscription as described in Section 4.

We may suspend or terminate your access to the Service at any time if you violate these Terms, if continued provision becomes commercially unreasonable, or if required by law. Sections 6 through 11 survive termination.

10. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. Nothing in this section limits any non-waivable consumer protection rights you have under the law of your country of residence.

11. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you inside the app. Your continued use of Habit Hound after the updated Terms take effect constitutes acceptance of the changes.
